BDA HOUSE OF DIPLOMACY LECTURE:
‘The Delicate Balance between Diplomatic Immunity and Local Jurisdiction (Belgium)’
Diplomatic immunity ensures foreign States, and their diplomats are protected from legal action in their host country, allowing them to perform their duties without fear of interference. This immunity, however, intersects complexly with local laws, e.g. regarding property and lease contracts. Foreign States and their diplomats are, in principle, exempt from local jurisdiction but this exemption is not absolute or always justified.
We analyse some case law and define the correct boundaries and balance between both valuable interests.
